Legal Protection
The first child was born by a gestational surrogate in the United States in 1985. Since that day, the US has become the only country where couples and individuals can safely pursue surrogacy both legally and medically. The US requires a surrogacy contract or agreement between the intended parents and the surrogate in order to protect the legal rights of everyone involved, including the unborn child. The contract is enforceable and unique to each surrogacy relationship and helps to ensure that everyone is in agreement regarding all aspects involved throughout the process.
Returning Home
Once the child is born, (and in many cases before the delivery), a US lawyer will file a birth order signed by the surrogate, the intended parents, and in some cases the surrogate’s husband. The birth order provides the legal parentage of the child and authorizes the intended parents to be listed as the child’s parents on the birth certificate.
